1. Scope

These General Terms and Conditions of Sale (GTC) apply to all orders placed with Bohemian Hug, either in physical store in Lausanne, or online via the website www.calinboheme.ch.

The applicable terms and conditions are those in effect. at the time of placing the order.

2. Products and services

Câlin Bohème offers handcrafted creations made by hand, in small series or to order.
Each product is carefully crafted, in a handcrafted spirit.

As the products are made to order, no modifications or customizations requested after order confirmation and payment can be accommodated. Any subsequent modification requests may be subject to additional charges.

3. Acceptance of conditions

All orders imply full and complete acceptance of these Terms and Conditions by the customer.

Câlin Bohème reserves the right to modify these Terms and Conditions at any time. The applicable terms are those in effect on the date of the order.

4. Guarantees, security and conditions of use

4.1 Warranty

The products come with a warranty of 90 days from the date of delivery, as confirmed by the shipping email.

The warranty covers defects or breakages found under normal conditions of use.
It does not cover:

• damage resulting from improper use,

• Failure to comply with instructions for use or maintenance,

• normal wear and tear from use.

If the product is covered under warranty, Câlin Bohème may, at its discretion, either replace it with an identical item or issue a credit in the form of a promotional code corresponding to the product's value, usable on the website. www.calinboheme.ch.

Products that have been used, damaged or broken after a period of 90 days will not be accepted for return, exchange, or refund.

4.2 Product Safety

Câlin Bohème carefully selects its suppliers and the materials used to manufacture its creations.

The products are designed in accordance with the safety requirements applicable to the products concerned, according to their category and use, and in accordance with current Swiss and European legislation.

The products are hand-assembled in Switzerland and undergo visual and functional testing before being put on sale.

4.3 Terms of Use

Products intended for children must always be used under adult supervision.

Before each use, the customer is required to check the condition of the product. In case of any signs of wear, deterioration or damage, the product must be removed immediately.

Any improper use, modification or misuse will be the responsibility of the user and will release Câlin Bohème from liability.

4.4 Distinction of product categories

Each product is intended for a specific use (childcare item, children's jewelry or adult jewelry).
The age and usage guidelines specified on the website must be strictly followed.

Jewelry intended for adults is designed to be worn by an adult and they are not toys. They are not suitable for use by a child.

5. Image rights and intellectual property

The photographs and visuals presented on the site are not contractual.
There may be color differences between the photos and the delivered products, particularly due to screen settings.

All content (texts, images, visuals, creations) remains the exclusive property of Câlin Bohème.
Any reproduction or use without written permission is prohibited.

6. Ordering Procedures

All online orders become final upon payment confirmation.
Clicking to validate constitutes an electronic signature and a contractual commitment.

The customer is responsible for the accuracy of the information provided (address, contact details). Câlin Bohème cannot be held liable for input errors resulting in a delay or inability to deliver.

7. Price

Prices are expressed in Swiss francs (CHF) and are understood All taxes included (TTC), excluding delivery charges.

Câlin Bohème is subject to VAT.
The applicable prices are those in effect at the time the order is registered.

8. Payment methods

The accepted payment methods are:

• Credit cards (Visa, Mastercard, American Express) via Stripe

• Bank transfer / advance payment

Card payments are secure and processed by Stripe. No banking information is stored by Câlin Bohème.

For payments by bank transfer, the order is shipped after receipt of payment.

9. Delivery

Free delivery is offered for purchases of CHF 50.– or more.

Available options:

• In-store pickup in Lausanne: free

• Standard delivery Switzerland: CHF 3.90

• Delivery with tracking in Switzerland: CHF 9.00

Orders are usually shipped within a certain timeframe. 7 business days after receipt of payment.
In case of unavailability or prolonged delay, the customer is informed.

Câlin Bohème cannot be held responsible for delays attributable to postal services or circumstances beyond its control.

10. Right of return

The customer has a period of 14 days from the date of receipt of the product to exercise the right of return.

The products must be returned:

• not used,

• in perfect condition,

• in their original packaging,

• at the client's expense.,

• via a traceable shipment.

Personalized products are neither returnable nor refundable, except in the case of a proven defect upon receipt.

The refund will be issued via the original payment method or, if applicable, in the form of a credit note.

11. Responsibility

Câlin Bohème cannot be held responsible for damages resulting from improper use, failure to follow instructions or lack of supervision when required.

Câlin Bohème's liability is limited to direct and foreseeable damages, within the limits permitted by applicable law.

In the event of delivery outside Switzerland, it is the customer's responsibility to verify the conformity of the products with the legislation of the destination country.

12. Applicable Law and Jurisdiction

These General Terms and Conditions are subject to Swiss law, in particular the Swiss Code of Obligations.

In the event of a dispute, the parties agree to seek an amicable solution.
Failing that, the The legal jurisdiction is Nyon (Switzerland)., subject to any overriding mandatory legal provisions.
